By accessing or using our website, submitting a booking request, participating in a chef listing, advertising with us, or engaging with any Hibachi with Us services, you agree to be legally bound by these Terms. Please read them carefully. If you do not agree, do not use our platform.

### 1. **Nature of Services**

Hibachi with Us is a **booking and promotional platform** that connects customers with independent vendors and chefs across the United States. We are not a food provider and do not participate in the preparation, handling, or cooking of food. All chefs and vendors listed on our platform operate independently and are solely responsible for their equipment, licensing, food safety, and service delivery.

Additionally, Hibachi with Us may promote other restaurants, chefs, or third-party food businesses through paid advertisements, social media content, marketing packages, or cross-promotions. Such advertising does not imply endorsement, guarantee, or vetting beyond what is publicly provided by the advertiser.

### 2. **Chef Independence and Liability Waiver**

All chefs booked through Hibachi with Us are **independent professionals**. Hibachi with Us:

- Does not supervise or control the chef’s behavior or preparation methods

- Is not liable for any foodborne illness, allergic reaction, injury, fire hazard, sanitation issue, or dissatisfaction

- Makes no guarantees regarding chef conduct, punctuality, food temperature, taste, cleanliness, or personal hygiene

By booking through our platform, you acknowledge and agree that all services are provided solely by the selected chef, and Hibachi with Us has no role in the execution of the event beyond providing booking and communication support.

### 3. **Booking Terms and Payment**

- Customers may request to book a chef through our platform. All booking requests are subject to availability.

- Prices are based on chef preferences, market conditions, group size, location, and menu selection.

- A deposit may be required to confirm your booking. Deposits are generally **non-refundable** unless otherwise stated.

- Remaining balances may be paid directly to the chef or through Hibachi with Us, depending on local arrangements.

- Service or technology fees may be added at the time of checkout and are **non-refundable**.

### 4. **Cancellations and Refunds**

Refunds are not guaranteed. Policies vary based on the chef’s own cancellation terms. Hibachi with Us does not issue refunds for:

- Customer cancellations made within 7 days of the event

- Customer dissatisfaction with food or chef behavior

- Environmental or safety conditions at the customer’s event location

- Miscommunication between customer and chef not related to our system error

In case of a chef’s cancellation, Hibachi with Us will make reasonable efforts to locate a replacement chef or issue a refund of your deposit. We make no promises regarding replacement availability.

### 5. **Advertising and Promotional Content**

Hibachi with Us may advertise chefs, restaurants, or third-party businesses. By using this website, you agree that:

- We may display paid advertisements

- Advertised businesses may not be vetted by Hibachi with Us

- We are not responsible for the conduct, quality, or outcomes of any advertised third-party services

- Any complaints or legal claims related to advertised services must be directed to the advertiser

Advertising clients may pay for:

- Priority listings

- Email features

- Social media shoutouts

- Video content, promotional reels, or featured placements on our platform

All advertising fees are non-refundable unless otherwise specified in a written agreement.

### 6. **Media Usage**

By booking with us or participating in a promotional listing, you grant Hibachi with Us the right to use photos, videos, or written feedback from your event or business for advertising purposes. This includes:

- Social media content

- Website promotion

- Marketing materials and press

If you wish to remove a specific piece of content featuring yourself or your guests, please email **info@hibachiwithus.com** and we will remove it promptly.

### 7. **Customer Responsibilities**

As a customer, you agree to:

- Provide a clean, accessible, and safe area for cooking

- Ensure there is protection from wind, rain, or unsafe conditions

- Communicate dietary restrictions and allergies in writing prior to the event

- Supervise guests and children around the cooking station

- Follow fire and safety laws relevant to your location

Chefs may refuse service or leave events if they determine the environment is unsafe or hostile.

### 8. **Limitation of Liability**

To the fullest extent permitted by law, Hibachi with Us disclaims all liability for:

- Any incident, injury, damage, illness, or dissatisfaction related to your booking

- The conduct or services of any chef or advertiser

- Technical failures, booking errors, missed communications, or third-party interruptions

- Claims exceeding the value of the booking fee paid directly to Hibachi with Us

We are not liable for indirect, incidental, punitive, or consequential damages under any circumstances.

### 9. **Waiver of Claims and Legal Action**

By booking or using our platform, you agree to fully **waive, release, and hold harmless** Hibachi with Us, its owners, team members, affiliates, vendors, and any chefs or service providers listed on the platform from **any and all claims, demands, lawsuits, damages, losses, or liabilities**, including legal fees, arising from:

- Your event

- Food preparation or consumption

- Accidents or property damage

- Personal injury, illness, allergic reactions, or dissatisfaction

- Any service or conduct related to an independent vendor or chef

This waiver applies to **any legal action**, including but not limited to negligence, breach of contract, or personal injury. This release is intended to be as broad and inclusive as permitted by law.

We reserve the right to remove users, advertisers, or chefs from our platform at our sole discretion, with or without cause. We also reserve the right to cancel bookings or suspend accounts in the event of suspected fraud, abusive behavior, or violation of these Terms.
